TERMS FOR CONDUCTING THE GAME
"AVALANCHE OF CHRISTMAS GIFTS"
1. GENERAL TERMS
1.1. These Terms for conducting the game "AVALANCHE OF CHRISTMAS GIFTS" ("Terms") regulate the order and conditions for conducting and participating in the game "AVALANCHE OF CHRISTMAS GIFTS" ("the Game").
1.2. The terms for conducting the Game are available for the entire duration of the Game on the website of "BULTEKS 99" Ltd.: https://stenso.net/.
1.3. The Organizer of the Game and the administrator of the personal data provided by the participants is "BULTEKS 99" Ltd., registered in the Commercial Register with UIC 115784032, with headquarters and management address: Plovdiv, postal code 4000, Central district, Vasil Aprilov Blvd. No., phone 032909700, email: office@bultex99.com 31 ("BULTEKS 99" or "the Organizer").
1.4. The Game period is from 00:00 on 01.12.2020 to 14:00 on 31.12.2020 ("Game Period").
1.5. The Game is organized and conducted in Bulgarian within the territory of the Republic of Bulgaria.
1.6. By participating in the Game, the participant is deemed to have read these Terms, accepts them voluntarily, and agrees to them.
1.7. Participants in the Game are obliged to comply with the provisions of these Terms. Participants who attempt to violate the rules of the Game by applying techniques and technologies that alter the mechanism of the Game will be automatically disqualified.
1.8. The names of the winners of the Game will be published/announced on the official Facebook page of "BULTEKS 99" Ltd.: https://www.facebook.com/bultex99/, so that all participants can check if they are among the winners. With the explicit consent of the winning participants, their photos and/or video images with the prizes will be published on the official Facebook page of "BULTEKS 99" Ltd.: https://www.facebook.com/bultex99/.
1.9. The Organizer reserves the right to change or supplement these Terms, with changes taking effect upon their publication on the website: https://stenso.net/. If a Participant disagrees with the changes to these Terms, they must cease participation in the Game and inform the Organizer in writing.
2. RIGHT TO PARTICIPATE
2.1. Every individual who is at least 18 years old and has a permanent/current address or residence in the territory of the Republic of Bulgaria has the right to participate in the Game, except for employees of BULTEKS 99, their family members (children, parents, spouses), as well as all individuals involved in the organization and conduct of the Game. Legal entities are not allowed to participate in the Game.
2.2. The right to participate in the Game is granted to any individual under item 2.1., who:
a) fulfill the conditions stated in the announcement intended for the Game on the official Facebook page of BULTEKS 99 LTD: https://www.facebook.com/bultex99/ and/or on the website: https://stenso.net/, and/or communicated on posters/displays at BULTEKS 99 LTD trading locations, and
b) correctly fill out the Game Participation Form/Ticket ("Form") published on the specified Facebook and internet pages or provided at the cash desks of BULTEKS 99 LTD trading locations in the country, during the period from 01.12.2020 to 31.12.2020 (14:00)
2.3. A Form is considered correctly filled out when all fields required by the Organizer are completed, including all consent checkboxes – to the Game Terms and the Organizer’s Privacy Policy, photo and video recording, etc.
2.4. Each participant is entitled to one (1) submission of the Game Participation Form. Any subsequent submissions will disqualify the participant from the Game.
3. CONDITIONS FOR PARTICIPATION IN THE GAME:
3.1. Participation in the Game is possible in one of the following ways:
- via the official Facebook page of BULTEKS 99 LTD: https://www.facebook.com/bultex99/;
- via the BULTEKS 99 LTD website: https://stenso.net/;
- at BULTEKS 99 LTD trading locations in the country.
3.2. To participate in the Game via Facebook, the participant must have an active Facebook profile and visit the official Facebook page of BULTEKS 99 LTD: https://www.facebook.com/bultex99/, as well as fulfill the conditions stated in the Game announcement.
3.3. To participate in the Game via the Internet, the participant must visit the BULTEKS 99 LTD website: https://stenso.net/, fulfill the conditions stated in the Game announcement, and correctly fill out the Game Participation Form, providing their full name, email address, and contact phone number.
3.4. To participate in the Game at BULTEKS 99 LTD trading locations in the country, the participant must visit one of the BULTEKS 99 LTD trading locations during working hours and correctly fill out the Game Participation Form, providing their full name, email address, and contact phone number.

3.5. Participation in the Game is free and not linked to the purchase of any specific product or service.
3.6. Only participants who meet the Game conditions and have fulfilled the participation requirements are included in the prize draw.
3.7. Each participant takes part in the prize draw only once and is entitled to receive only one prize for the entire Game period.
3.8. Participants who registered for the Game after the Game period has ended will not be considered participants and their names will not be included in the prize draw.

4.2. The selection of winners and distribution of prizes is carried out by special software on a random (lottery) basis (drawing of lots), on the following dates:
- 1st drawing – 09.12.2020 for participants in the Game for the period 01.12.2020 - 07.12.2020
- 2nd drawing – 16.12.2020 for participants in the Game for the period 08.12.2020 - 14.12.2020
- 3rd drawing – 23.12.2020 for participants in the Game for the period 15.12.2020 - 21.12.2020
- 4th drawing – 30.12.2020 for participants in the Game for the period 22.12.2020 - 28.12.2020
- final drawing – 31.12.2020 for all participants in the Game for the period 01.12.2020 - 30.12.2020
4.3. A total of 50 (fifty) prizes are awarded in the Game. Each drawing awards a total of 10 (ten) prizes, with 5 (five) prizes allocated to participants who entered via the official BULTEKS 99 Facebook page: https://www.facebook.com/bultex99/, and the remaining 5 (five) prizes allocated to participants who entered via the BULTEKS 99 website: https://stenso.net/ and in BULTEKS 99 retail outlets across the country, for the respective period.
4.4. The drawing of the winning Participants is conducted by a Commission composed of 3 (three) employees from the Organizer's administration. The results of the drawing of the winning participants are duly recorded by the Commission in a protocol, which lists the names of the winning Participants in the order they were drawn.
4.5. Drawing of the winning Participants is held weekly during the Game period, on the dates specified in section 4.2. (weekly drawing). On 31.12.2020, a final drawing is held among all participants in the Game for the entire duration of the Game. During the weekly and final drawings, prizes for participants who entered via Facebook are drawn first, followed by prizes for those who participated via the website and in BULTEKS 99 retail outlets across the country.
4.6. On the day of the draw, the names of the winning participants will be announced on the BULTEKS 99 Facebook page: https://www.facebook.com/bultex99/. Winners will also be notified via the email addresses provided in the registration form for the Game. Participants who entered via the Facebook page must send their personal data – first and last name, email address, and contact phone number – in a private message to the Facebook page https://www.facebook.com/bultex99 within 5 (five) days of the announcement of the winners. If the winning participant does not send a private message to the Organizer and provide the necessary data within the specified period, they lose the right to receive the prize, and the Organizer will draw another winner in their place.
4.7. Winners who participated in the game via the website https://stenso.net/ and in BULTEKS 99 retail locations nationwide must respond no later than 5 days after receiving the informational email, confirming their desire to receive the prize and providing the necessary data for delivery.
4.8. If the winning participant does not respond within 5 days after receiving the informational email, they lose the right to receive the prize. In this case, it is considered that the winning participant has forfeited their prize, and BULTEKS 99 will draw another participant for the prize and contact them.
4.9. BULTEKS 99 is not responsible if it is impossible to contact the winning participant due to incorrect contact details provided or other reasons beyond the Organizer’s control.
4.10. The prizes in the Game are tangible and awarded as announced; they cannot be exchanged for others or redeemed for their cash value.
4.11. Prizes are delivered free of charge by courier to each winning participant within 30 working days after the Participant provides a delivery address. On the day of delivery, the winning participant will receive a notification SMS or a call from the courier. Prizes are delivered to the address provided by the Participant only once. If the winning Participant is absent from the provided address, they will receive a call with additional instructions on how to collect the prize within 7 (seven) days from the respective courier branch. After this period, the winning participant loses the right to receive the prize, which will be returned and used by the Organizer for an additional draw according to section 4.8.
4.12. The Organizer is not responsible when the Participant has provided an incorrect or incomplete address that may cause difficulties in delivery or make it impossible, or when the Participant cannot be found or contacted via the phone number provided during registration.
4.13. The costs for deliveries by the respective courier company are borne by the Organizer. Winners are not required to pay any amount related to the delivery of their prizes.
4.14. Prizes are awarded only upon presentation of an identity document. Upon receiving the prize, each Participant must sign a receipt and a Handover Protocol to confirm the receipt of the prize.
4.15. The prizes in the Game are considered tangible prizes of insignificant value according to Article 13, paragraph 1, item 21 of the Personal Income Tax Act ("PITA") and are non-taxable.
5. TERMS FOR PROCESSING THE PERSONAL DATA OF PARTICIPANTS IN THE GAME
5.1. BULTEKS 99, as the Data Controller, processes the following personal data of all Participants in the Game: first and last name, phone number, and email, provided in the submitted Participation Forms on the website https://stenso.net/ and the Organizer's physical stores.
5.2. The personal data specified are processed solely for the purposes for which they were originally collected. In the event of any change regarding the purposes or means of processing, the Organizer shall immediately contact the Participants to provide them with additional information.
5.3. The processing of personal data of the Participants in the Game is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("General Data Protection Regulation" or "GDPR") and Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector, as well as applicable Bulgarian legislation.
5.4. The purpose of processing the personal data of participants in the Game is to determine the winners of the game in an indisputable manner, identify them, announce the results of the Game, and establish contact with the winners, as well as for marketing purposes related to products, services, or advertising campaigns of BULTEKS 99.
5.5. By giving consent to participate in the Game, participants voluntarily provide the Organizer with their personal data for the purposes stated above. The data will be processed until the reason for processing ceases to exist.
5.6. The Organizer stores the aforementioned personal data solely within the territory of the Republic of Bulgaria.
5.7. The Organizer guarantees that all necessary technical and organizational measures have been taken to protect the personal data of the game participants, ensuring control over access to equipment, data carriers, storage, transfer, and more.
5.8. Data subjects (registered Participants in the Game) have the right to:
- the right to receive information regarding the processing of their personal data by the Organizer;
- the right to access their personal data;
- the right to correction when the data is inaccurate;
- the right to have their personal data deleted, although this right is not absolute (the "right to be forgotten");
- the right to data portability between different controllers;
- restriction of processing by the Organizer;
- objection to the processing of their personal data;
- the right to protection in case of violation of their rights under applicable law.
5.9. The Organizer shares the personal data of the Participants with third parties for the purpose of conducting the Game. Participants' personal data is provided to our partners, including courier service providers and marketing companies.
5.10. The personal data of the Participants shared with third parties is limited to the minimum necessary for the execution of the purpose intended by our partners. Personal data is provided to courier service providers for the delivery of won prizes, and to marketing companies for the successful conduct of the Game and maintaining the Organizer’s profiles on social platforms for the promotion of the Game and the Organizer’s commercial activities.
5.11. The personal data of the Participants may also be provided to other third parties in the following cases:
1. Compliance with a legal requirement, consideration of pre-trial or judicial proceedings, orders, or processes directly or indirectly related to the Organizer;
2. When required in the event of transformation, liquidation, or insolvency of the Organizer;
3. In fulfillment of a legally established obligation or by virtue of an authoritative act of a public authority, including tax authorities;
4. When the provision of data is necessary to protect the rights, interests, or property of the Organizer; or
5. When required or permitted by law.
5.11. In case of a personal data security breach, the Organizer is obliged to take the necessary actions to protect the rights and interests of the Participants within the cases and deadlines provided by law.
5.12. The competent supervisory authority in the territory of the Republic of Bulgaria regarding personal data protection issues is the Commission for Personal Data Protection, located at Sofia, 1592, 2 Tsvetan Lazarov Blvd., Tel. +359 2 915 3580, fax +359 2 915 3525, e-mail: kzld@cpdp.bg, website: http://www.cpdp.bg/
5.13. If you have questions regarding the personal data of Participants and their processing or the exercise of any of the above rights, you can contact the Organizer by sending a message to the email address: office@bultex99.com.
5.14. Every participant in the Game has the right to exercise their rights related to the protection of their personal data by submitting a written application to the manager of BULTEKS 99 at the address: Plovdiv, P.O. Box 4000, 31 Vasil Aprilov Blvd., which should contain: name, address (including email address), other data identifying the respective participant, description of the request, and preferred form of information delivery. The application must be signed, dated, and include a correspondence address. The application must be submitted personally by the individual/their legal representative or an expressly authorized person through a notarized power of attorney. An application can also be submitted via the rights exercise form as well as by email at: office@bultex99.com.
5.15. All participants have the opportunity to express disagreement regarding the processing of their data for direct marketing purposes at the time of providing this data for the use of the service (participation in the game, for the purpose of winning material prizes). Disagreement can be expressed free of charge at the email address: office@bultex99.com. Individuals who have not expressed such disagreement at the time of submitting the application and providing the data may express disagreement at any time regarding future receipt of such messages. Please note that BULTEKS 99 will process contact data for direct marketing purposes to inform you about its best offers, from which you can choose to benefit first at your discretion, but BULTEKS 99 will immediately comply with any refusal to receive messages.
5.16. The refusal to receive messages for direct marketing purposes, if made after submitting the application, applies from that point forward.
5.17. Winning participants are informed that in the event of receiving a prize, their names and, possibly, with explicit consent – their photo or video material from the award ceremony, may become public and be used on the website https://stenso.net/ in audio, print, and video materials of the Organizer for a period of 3 (three) months after the end of the Game.
5.18. The Organizer guarantees that the personal data of individuals will not be processed for purposes other than those specified in these rules. BULTEKS 99 guarantees that the data will not be processed for direct marketing and advertising purposes after the respective individuals have opted out.
5.19. For issues not regulated in these Terms regarding the processing of personal data by BULTEX 99, the Privacy Policy of BULTEX 99 applies, available at https://stenso.net/content/2-politika-za-poveritelnost.
6. OTHER TERMS
6.1. The Organizer has the irrevocable right to unilaterally change the rules of the Game or terminate the game at any time, announcing this in accordance with these rules. In such cases, participants are not entitled to compensation. The Organizer is not responsible for any losses or missed benefits incurred by participants as a result of such termination.
6.2. The Organizer has the irrevocable right to terminate the Game at any time. Termination may be due to violation of these Terms, material abuses, changes in Bulgarian legislation, prohibitions or orders from state authorities to stop or suspend such campaigns and games, the occurrence of force majeure circumstances, and any other circumstances beyond the Organizer’s control.
6.3. The Organizer of the Game is not responsible if the prize is not delivered due to incorrect, inaccurate, or incomplete names, email, contact details, or delivery address provided by the participant, if the participant did not provide a valid contact phone number and/or made an error entering it, if they failed to notice the winning notification and prize confirmation, or did not do so within the 5-day confirmation period.
6.4. The Organizer of the Game is not obliged to correspond regarding unsuccessful claims after the game period has expired or for similar reasons.
6.5. If actions are detected that aim to and/or could lead to manipulation of the results in the distribution of prizes, the Organizer reserves the right to disqualify the respective participant and deprive them of the right to receive the prize won as a result of such actions. The Organizer has the right to unilaterally remove from the Game any person found to have violated, circumvented, or abused the Game and/or the rules set forth in these Terms.
6.6. These Terms and the conduct of the Game comply with Bulgarian legislation. For issues not regulated in the Terms, the current legislation of the Republic of Bulgaria shall apply.
6.7. Any dispute arising between the Organizer and the participants in the game shall be resolved by mutual agreement between the parties; if such agreement cannot be reached, the dispute shall be referred to the competent court in Plovdiv for resolution.
