c) declaring unequivocally in another manner their decision to withdraw from the contract. Information on exercising the right of withdrawal is available at "Withdrawal, returns and exchange" and in Annex No. 2 to these General Terms and Conditions.

(4)  The MERCHANT may provide the CUSTOMER with the possibility to exercise the right of withdrawal by completing and sending electronically, through the website of the online store bultex99.com, a standard withdrawal form, Annex No. 1 to these General Terms and Conditions, or a withdrawal form, Annex No. 3 to these General Terms and Conditions, or another unequivocal statement. In this case, the MERCHANT immediately sends the CUSTOMER a confirmation of receipt of their withdrawal on a durable medium and/or by e-mail.

(5) The exercise of the right of withdrawal terminates the obligations of the parties to perform the contract or to conclude the contract – where an offer to conclude it has been made by the CUSTOMER.

Art. 23. (1) Where the CUSTOMER has exercised their right of withdrawal from the distance or off-premises contract, the MERCHANT shall refund all amounts received from the CUSTOMER, with the exception of the delivery costs where the CUSTOMER has chosen a method of delivery other than the least expensive standard method of delivery offered by the MERCHANT (free delivery), as well as the costs of returning the goods, without undue delay and no later than 14 days from the date on which it was informed of the CUSTOMER's decision to withdraw from the contract.

(2) The MERCHANT refunds the amounts received by bank transfer, using the same means of payment used by the CUSTOMER in the initial transaction, unless the CUSTOMER has expressly agreed to the use of another means of payment and provided that this does not entail any costs for the CUSTOMER.

(3) The Merchant is not obliged to refund the additional costs for delivery of the goods where the CUSTOMER has expressly chosen a method of delivery of the goods other than the least expensive type of delivery offered by the MERCHANT, namely: free delivery.

(4) The MERCHANT may withhold payment of the amounts to the CUSTOMER until it has received the goods back or until the CUSTOMER has supplied evidence of having sent back the goods, whichever is the earliest.

Art. 24. (1) Where the CUSTOMER exercises their right of withdrawal from the contract, they must send back or hand over the goods to the MERCHANT or to a person authorised by it without undue delay and no later than 30 days from the date on which the CUSTOMER communicated to the MERCHANT their decision to withdraw from the contract, and shall bear the costs of returning the goods.

(2) Pursuant to Art. 55, para. 2 of the Consumer Protection Act, the costs of returning the goods are borne by the CUSTOMER.

(3) The goods are returned/handed over in person or sent, without cash on delivery, to the following address of the Merchant: Plovdiv, 8 Karlovsko Shose Blvd., together with all documents related to the delivery: cash receipt or invoice, handover protocol, warranty card, etc. (if such have been issued).

(4) The CUSTOMER undertakes to exercise due care while storing the goods received from the MERCHANT, ensuring the preservation of their quality and safety during the period under para. 1. The CUSTOMER must return or send the goods in good merchantable condition allowing them to be offered for resale, and is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning.

(5) Until the moment of return or handover of the goods to the MERCHANT's address under para. 3, the risk of accidental perishing, loss or damage of the goods is borne entirely by the CUSTOMER.

Art. 25. Where the CUSTOMER exercises their right of withdrawal from the contract, any ancillary contract is automatically terminated without the CUSTOMER owing any additional costs, compensation or penalties. In this case, the CUSTOMER is deemed to have also exercised the right of withdrawal with respect to the bonus content and all gifts received together with the delivered goods.

Art. 26. (1) Pursuant to Art. 57 of the Consumer Protection Act, the right of withdrawal does not apply to contracts:

  • for the supply of goods whose price is dependent on fluctuations in the financial market which cannot be controlled by the MERCHANT;

  • for the supply of goods made to the Customer's order or according to their individual requirements (e.g. production of a special model, emblem, embroidery, screen printing, corporate insignia);

  • for the supply of sealed goods which have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection;

  • for the supply of goods which, after delivery and by their nature, have become inseparably mixed with other goods;

  • for the supply of goods with compromised integrity or damaged packaging (respiratory protection filters);

  •  in the other cases under Art. 57 of the Consumer Protection Act.

Art. 27. Under the conditions of Art. 22-26 of this section, instead of withdrawing from the sales contract the CUSTOMER has the right to request an exchange of the goods for other goods (replacement delivery) offered through the online store, by sending in writing a completed Return, exchange and complaint form, Annex No. 3, and returning the goods for exchange in their preserved packaging. The costs of returning the goods to the MERCHANT and of delivering the new (replacement) goods to the CUSTOMER are borne by the CUSTOMER, pursuant to Art. 55, para. 2 of the Consumer Protection Act.

IX. GUARANTEES AND COMPLAINTS

In the event of a lack of conformity of the goods with the sales contract, the CUSTOMER has the right to lodge a complaint, requesting that the MERCHANT bring the goods into conformity with the sales contract. Art. 29. (1) Where the goods do not conform to the sales contract, the MERCHANT is obliged to bring them into conformity within 1 (one) month from the lodging of the complaint by the CUSTOMER.

(2) The CUSTOMER may not claim rescission of the contract if the lack of conformity of the goods with the contract is minor.

(3) The complaint may be lodged with the MERCHANT or with a person authorised by it within 2 (two) years from the delivery of the goods, but no later than two months from the discovery of the  lack of conformity, if the CUSTOMER is a consumer within the meaning of the Consumer Protection Act.

Art. 31. (1) A commercial guarantee is any undertaking given by the merchant or the producer to the CUSTOMER, in addition to its legal obligation to ensure conformity of the goods with the sales contract, to refund the price paid or to replace or repair the goods, or to provide another type of service, where the goods do not meet the specifications and other conformity requirements set out in the commercial guarantee statement or in the relevant advertising made at the time of or before the conclusion of the contract.
