TERMS FOR CONDUCTING THE GAME

„CHAMPIONS GAME WITH BULTEKS 99“

1. GENERAL TERMS

1.1. These Terms (“Terms”) regulate the order and conditions for conducting and participating in the game „CHAMPIONS GAME WITH BULTEKS 99“ (“The Game”).

1.2. The Terms of the Game are available for the entire duration of the Game on the website of the online store of “BULTEKS 99” Ltd.: https://www.stenso.net/.

1.3. The Organizer of the Game and the administrator of the personal data provided by participants is “BULTEKS 99” Ltd., registered in the Commercial Register with UIC 115784032, with headquarters and management address: Plovdiv, postal code 4000, Central district, Vasil Aprilov Blvd. No. 31, phone 032909700, email: office@bultex99.com („BULTEKS 99” or “The Organizer“).

1.4. The Game period is from 00:00:00 on 14.08.2024 to 11:00:00 on 10.09.2024 (“Game Period“).

1.5. The Game is organized and conducted on the website: , in Bulgarian language and within the territory of the Republic of Bulgaria.

1.6. By participating in the Game, the participant is considered informed and acquainted with its rules and these Terms, accepts them voluntarily, and agrees to comply with them.

1.7. Participants in the Game are obliged to comply with these Terms. Participants who attempt to violate the Game rules by applying techniques and technologies that alter the Game mechanism and aim to increase the chance of winning a prize will be automatically disqualified.

1.8. The names of the winners of the Game will be published/announced on the website: https://www.stenso.net so that all participants in the Game can check whether they are among the winners.

1.9. The Organizer reserves the right to amend or supplement these Terms, with changes taking effect upon their publication on the website: https://www.stenso.net/If a Participant disagrees with the changes to these Terms, they may cease their participation in the Game by sending the Organizer a written notice within one month from the date of publication on the website. If the Organizer is not notified within the specified period, the changes to these Terms shall take effect and bind the Participant.

2. RIGHT TO PARTICIPATE

2.1. Every legally capable natural person aged 18 or older, who has a permanent/current address or residence in the territory of the Republic of Bulgaria, except employees of BULTEKS 99 Ltd., their family members (children, parents, spouses), as well as all natural persons involved in the organization and conduct of the Game, has the right to participate in the Game. Legal entities are not entitled to participate in the Game. By participating in the Game, the Participant confirms that they are over 18 years old and legally capable. 

2.2. Every natural person under item 2.1. who:

1. fulfill the participation conditions of the Game, specified in the Game announcement on the website: https://stenso.net/content/38-usloviya-na-igrata during the Game Period. 

2. correctly fill out the Form / Application for participation in the Game on the website: https://stenso.net/igra или в избран от него търговски обект на БУЛТЕКС 99 (в рамките на обявеното за обекта работно време), през Периода на провеждане на Играта.

2.3. Correctly filling out the Form / Application for participation is considered when all fields requested by the Organizer are completed, including all consent checkboxes – with the Game Conditions and processing of personal data by the Organizer, photo and video recording, etc.

3. CONDITIONS FOR PARTICIPATION IN THE GAME:

3.1. Participation in the Game is possible in one of the following ways:

1. through the website:https://stenso.net/igra , maintained by BULTEKS 99;

2. in BULTEKS 99 retail outlets in the country, listed in the following list:

3.2. To join the Game via the Internet, the participant must fulfill one of the following conditions during the Period of its conduct: 

1. to purchase product(s) of their choice from a BULTEKS 99 retail outlet in Bulgaria or from the online store https://www.stenso.net, with a minimum value of 10 BGN /ten leva/, in a single purchase, registered by issuing a receipt from a fiscal device or IASUTD (fiscal or system receipt, printed on paper or in electronic form) or an invoice issued by "BULTEKS 99" Ltd. For purchases made with a credit or debit card through the online store https://www.stenso.net, BULTEKS 99 issues another document to register the sale, which it sends to the Participant electronically. 

2. to register their participation in the Game through the website: https://www.stenso.net, during the period from 14.08.2024 to 10.09.2024, 11:00 a.m., by correctly filling out the electronic Form / Application / for participation in the Game on the website: https://stenso.net/igra , provide the Organizer with the necessary personal data for participation in the Game and receiving the prize (name and surname, postal and email address, and contact phone number) 

3. to confirm in the Participation Form their agreement with the Game conditions, including the processing of their personal data for the purposes of participation in the Game and prize distribution.  

3.3. To participate in the Game through BULTEKS 99 retail outlets in the country, the Participant must fulfill the following conditions during the Period of its conduct: 

a) to purchase product(s) of their choice from a BULTEKS 99 retail outlet in Bulgaria or from the online store https://www.stenso.net, with a minimum value of 10 BGN /ten leva/, in a single purchase, registered by issuing a receipt from a fiscal device or IASUTD (fiscal or system receipt, printed on paper or in electronic form) or an invoice issued by BULTEKS 99. For purchases made with a credit or debit card through the online store https://www.stenso.net, BULTEKS 99 issues another document to register the sale, which it sends to the Participant electronically. 

b) to register their participation in the Game through BULTEKS 99 retail outlets in the country during the period from 14.08.2024 to 10.09.2024, 11:00 a.m., by correctly filling out the Participation Form on paper and submitting it to a cashier at a BULTEKS 99 retail outlet, providing the necessary personal data for participation in the Game and prize receipt (name and surname, postal and email address if available, and contact phone number) and registering the receipt number (fiscal/system receipt), invoice number, or other document for the purchase made.

c) to confirm in the Participation Form their agreement with the Game conditions, including the processing of their personal data for the purposes of participation in the Game and prize distribution.  

3.4. Each participant can participate an unlimited number of times in the Game and for prize distribution, provided that separate purchases are registered.

3.5. Each participant must keep until the end of the Game the receipts, invoices, or other documents proving the purchase registered during their participation in the Game on the website of https://www.stenso.net or at BULTEKS 99 retail outlets in the country. When awarding the prizes, the Organizer or its representative has the right to request from the Participant a receipt, invoice, or other purchase document registered by the winning Participant during their participation in the Game, as a necessary condition for receiving the prize.

3.6. Participants who registered for the Game after the end of the Game period will not be considered participants and their names will not be included in the prize draw.

4. PRIZES AND WINNER SELECTION

4.1. Participation in the Game organized by Bulteks 99 gives the opportunity to win the following prizes, namely:

30 pcs. Tickets for the Tennis Gala match between Grigor Dimitrov and Novak Djokovic on 17.09.2024 at 8 p.m. at Arena Sofia, each worth BGN 100.

300 pcs. Discount coupon worth 15% for a one-time purchase up to BGN 1000. 

30 pcs. Discount coupon worth 30% for a one-time purchase up to BGN 1000.

300 pcs. BULTEKS 99 promotional T-shirts

4.2. Coupons can only be used in the online store https://stenso.net/. for a one-time purchase not exceeding BGN 1000. When placing an online order in the BULTEKS 99 online store: https://www.stenso.net, indicated in the coupon promo code is registered before finalizing the order and is automatically reflected as a discount on the total order amount according to the discount provided in the coupon. Discount coupons cannot be combined with other discounts or promotions.

4.3. A total of 660 (six hundred and sixty) prizes, which are distributed equally among those who participated in the Game via the website https://www.stenso.net and through BULTEKS 99 retail outlets in the country. 

4.4. The determination of the winners and the distribution of prizes is carried out by special automated software randomly (drawing), on 10.09.2024 at 12:00 PM. 

4.5. The drawing of the winning Participants is conducted by a Commission consisting of 3 (three) employees from the Organizer's administration. The results of the draw of the winning participants are recorded by the Commission in a protocol, which lists the names of the winning Participants in the order they were drawn.

4.6. On the day of the draw, the names of the winning participants are announced on the website https://stenso.net.

4.7. The game Organizer contacts the winning participants at the phone number and email address provided in the registration Form for the Game, within 5 (five) days from the announcement of the winners.

4.8. If within the period specified in section 4.7 the winning participant cannot be reached at the phone number and email address provided. If the winning Participant does not respond to the Organizer within 5 days after the email is sent, they lose the right to receive the prize. In this case, it is considered that the winning participant has declined the prize, and the Organizer will draw another participant for the prize and contact them.

4.9. The Organizer is not responsible if it is impossible to contact the winning participant due to incorrect contact details provided or other reasons beyond the Organizer's control.

4.10. Won prizes cannot be changed or exchanged for another prize by the winning participants, cannot be exchanged for their cash equivalents, prizes are non-refundable and non-transferable. The Organizer reserves the right to replace the prizes (or part of them) with a prize (or prizes) of equivalent or higher monetary value if necessary due to reasons beyond its control, by notifying participants in advance through a publication of changes to these rules. If the winning Participant does not accept the replacement, they lose the right to receive a prize from the Game.

4.11. Prizes are received personally by the winning Participants, via the Participant's email address, or are delivered free of charge by courier within 30 working days after the Participant provides a delivery address. On the day of delivery, the winning participant will receive a notification SMS or a call from the courier. Prizes are delivered to the address provided by the Participant only once. If the winning Participant is absent from the provided address, they will receive a call with additional instructions to collect the prize within 7 (seven) days from the respective courier branch. After this period, the winning participant loses the right to receive the prize, which will be returned and used by the Organizer for an additional draw according to section 4.8.

4.12. The Organizer is not responsible if the Participant has provided an incorrect or incomplete address that may cause difficulties in fulfilling the delivery or make it impossible, or if the Participant cannot be found or contacted via the phone number provided during registration.

4.13. The costs of deliveries by the respective courier company are borne by the Organizer. Winners are not required to pay any amount related to the delivery of their prizes.

4.14. Prizes are received only upon presentation of an identity document. Upon receiving the prize, each Participant must sign a receipt and a Handover Protocol to confirm the receipt of the prize. 

4.15. The prizes in the Game are considered tangible prizes of insignificant value (market value up to BGN 100, according to Art. 13, para. 1, item 21 of the Personal Income Tax Act ("PITA")) and are non-taxable.

5. CONDITIONS FOR PROCESSING THE PERSONAL DATA OF THE PARTICIPANTS IN THE GAME

5.1. BULTEKS 99, as the Data Controller within the meaning of §1, item 2 of the Additional Provisions of the Personal Data Protection Act, processes a) personal data of the Participants in the Game: first and last name, phone number, and email, provided in the submitted Participation Forms on the website www.stenso.net and the organizer's physical stores, as well as b) personal data of the winners and reserve Participants in the Game: locality and specific delivery address. The Organizer has appointed an employee as the data protection officer for the participants in the Game: Nadezhda Trifonova, phone: +359 885 810 778, e-mail: marketing@bultex99.info.  

5.2. The specified personal data are processed solely for the purposes for which they were originally collected. In the event of any change regarding the purposes or means of their processing, the Organizer shall immediately contact the Participants to provide them with additional information.

5.3. The processing of the personal data of the Participants in the Game is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("General Data Protection Regulation" or "GDPR") and Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector, as well as with the applicable Bulgarian legislation.

5.4. The purpose of processing the personal data of participants in the Game is to create conditions for participation in the game and registration of participants, determine the winners of the game in an indisputable manner, identify them, announce the results of the Game, contact the winners, and provide prizes to the winning participants, as well as for the purposes of conducting advertising and marketing campaigns for products, services of BULTEKS 99 and its commercial activities.

5.5. By giving consent to participate in the Game, participants voluntarily provide the Organizer with their personal data for the above purposes. The data will be processed until the basis for this ceases. If the Participant does not provide or withdraws the given consent, participation in the Game is impossible.

5.6. The legal grounds for processing the personal data of participants in the Game are: 

1. Art.6, para.1, item "b" GDPR – processing is necessary for conclusion and execution of a contract to which the Participant is a party;

2. Art.6, para.1, item "e" GDPR – processing is based on the legitimate interest of Bultex 99 in conducting promotional or marketing games and improving service;

3. Art.6, para.1, item "a" GDPR – processing is with the consent of the participant in the Game

5.7. The Organizer stores the personal data of the Participants in the Game solely within the territory of the Republic of Bulgaria for the periods specified in the following table:

5.8. The Organizer guarantees that it has taken the necessary technical and organizational measures to protect the personal data of the game participants, ensuring control and limiting access to equipment, data carriers, and the data itself only to specially designated employees.

5.8. Data subjects (Participants in the Game) have the following rights:

• the right to receive information related to the processing of their personal data;

• the right to access their personal data;

• the right to correct their personal data when it is inaccurate or incomplete;

• the right to have their personal data deleted, although this right is not absolute (the "right to be forgotten");

• the right to data portability between different controllers;

• the right to restrict processing by the Organizer;

• the right to object to the processing of their personal data for direct marketing purposes;

• the right to file a complaint with the CPDP in case of violation of their rights under the applicable personal data protection legislation.

5.9. The Organizer shares the personal data of the Participants with third parties for the purpose of conducting the Game. Participants’ personal data may be provided to the Organizer’s partners, including courier service providers and marketing companies.

5.10. The personal data of the Participants shared with third parties is limited to the necessary minimum for the execution of the purpose intended by the partners. Personal data is provided to courier service providers for the delivery of won prizes, and to marketing companies for the successful conduct of the Game and maintaining the Organizer’s profiles on social platforms to promote the Game and the Organizer’s commercial activities.

5.11. The personal data of the Participants may also be provided to other third parties in the following cases:

1. Compliance with a legal requirement, consideration of pre-trial or judicial proceedings, orders, or processes directly or indirectly related to the Organizer;

2. When required in the event of transformation, liquidation, or insolvency of the Organizer;

3. In fulfillment of a legally established obligation or by virtue of an authoritative act of a public authority, including tax authorities;

4. When the provision of data is necessary to protect the rights, interests, or property of the Organizer; or

5. When required or permitted by law.

5.12. In case of a personal data security breach, the Organizer is obliged to take the necessary actions to protect the rights and interests of the Participants within the cases and deadlines provided by law.

5.13. The competent supervisory authority in the territory of the Republic of Bulgaria regarding issues related to personal data protection is Commission for Personal Data Protection, with address Sofia, P.O. 5.14. If you have questions regarding the personal data of Participants and their processing or exercising any of the above rights, you can contact the Organizer by sending a message to the email address: office@bultex99.com.

5.15. Every participant in the Game has the right to exercise their rights related to the protection of their personal data by submitting a written application to the manager of BULTEKS 99 at the address: Plovdiv, P.O. Box 4000, Vasil Aprilov Blvd. No. 31, which should contain: name, address (including email address), other data identifying the respective participant, description of the request, and preferred form of information provision. The application must be signed, dated, and include a correspondence address. The application must be submitted personally by the individual/their legal representative or an expressly authorized person through a notarized power of attorney. 5.16. All participants have the opportunity to express disagreement regarding the processing of their data for direct marketing purposes at the time of providing this data for using the service (participation in the game, for the purpose of winning material prizes). Disagreement can be expressed free of charge at the email address: marketing@bultex99.infoIndividuals who have not expressed such disagreement at the time of registration for participation in the game and providing data have the opportunity at any time to express disagreement with future receipt of such messages. Please note that BULTEKS 99 will process contact data for direct marketing purposes to inform you about its best offers, which you can choose to take advantage of first, but BULTEKS 99 will immediately comply with any refusal to receive messages.

5.17. Refusal to receive messages for direct marketing purposes, if made after submitting the application, applies from then on. BULTEKS 99 guarantees that the data will not be processed for direct marketing and advertising purposes after refusal by the respective individuals.

5.18. Winning participants are informed that in case of receiving a prize, their names and, possibly, with explicit consent – their photo or video material from the award ceremony, may become public and be used on the internet address https://www.stenso.net/ in the Organizer's audio, print, and video materials for a period of 3 (three) months after the end of the Game.

5.19. The Organizer guarantees that the personal data of individuals will not be processed for purposes other than those specified in these rules. 

5.20. For issues not regulated in these Terms regarding the processing of personal data by BULTEKS 99, the Privacy Policy of BULTEKS 99 applies, available at https://stenso.net/content/2-politika-za-poveritelnost.

6. OTHER TERMS

6.1. The Organizer has the irrevocable right to unilaterally change the rules of the Game or terminate the game at any time, announcing this in accordance with these rules. In such cases, participants are not entitled to compensation. The Organizer is not responsible for any losses or missed benefits incurred by participants as a result of such termination.

6.2. The Organizer has the irrevocable right to terminate the Game at any time. Termination may be due to violation of these Terms, material abuses, changes in Bulgarian legislation, prohibitions or orders from state authorities to stop or suspend such campaigns and games, the occurrence of force majeure circumstances, and any other circumstances beyond the Organizer's control.

6.3. The Organizer of the Game is not responsible if the prize is not delivered due to incorrect, inaccurate, or incomplete names, email, contact details, or delivery address provided by the participant, if the participant did not provide a valid contact phone number and/or made an error entering it, if they missed the notification of winning and confirmation of the prize, or did not do so within the 5-day confirmation period.

6.4. The Organizer of the Game is not obliged to correspond regarding non-winning claims after the game period has expired or for similar reasons.

6.5. If actions are detected that aim to and/or could lead to manipulation of the results in the distribution of prizes, the Organizer reserves the right to disqualify the respective participant and deprive them of the right to receive the prize won as a result of such actions. The Organizer has the right to unilaterally remove from the Game any person found to have violated, circumvented, or abused the Game and/or the rules set out in these Terms.

6.6. These Terms and the conduct of the Game comply with Bulgarian legislation. For issues not regulated in the Terms, the current legislation of the Republic of Bulgaria shall apply.

6.7. Any dispute arising between the Organizer and the participants in the game shall be resolved by mutual agreement between the parties, and if such agreement cannot be reached, the dispute shall be referred for resolution to the competent court in Plovdiv.
